Frequently Asked Questions about Plaintiff Pre-Settlement Funding

1Who is eligible for a pre-settlement funding advance?

If you have or plan to file a lawsuit and are represented by an attorney, you are eligible for pre-settlement lawsuit funding. You are also eligible if you have settled your case and are awaiting payment. Please note that we do not provide pre-settlement funding services to anyone under the age of 18.

Please note LawCash® provides pre-settlement funding in North Carolina only for requests and funding advances over $25,000.00.

2Can LawCash help me pay my medical bills/rent/other living expenses even if I do not have a lawsuit or legal claim?
Unfortunately, no. We provide pre-settlement funding to plaintiffs and injured individuals who have not yet filed suit while waiting for their cases to unfold. We cannot provide litigation funding unless a legal claim or lawsuit is involved.
3What is a lawsuit loan? Does pre-settlement funding work like a traditional loan?
Although many use the term “lawsuit loans” when referring to plaintiff funding services, that term is not accurate. LawCash® pre-settlement funding is NOT a loan. If we fund your case, you will only have to repay if you settle or win the lawsuit. If you lose your case, you owe us nothing. Unlike a loan, it is a non-recourse funding advance. You repay the advance ONLY if you win.
4If I use litigation funding, how much money will I owe up front?
None. You will owe no money for litigation financing up front. There are no monthly payments. You must repay LawCash® only if you win or settle your case. If you lose your case, you owe us nothing.
5How long does it take to receive pre-settlement funding?
It depends on the case. We can get you your Settlement Funding Advance on the same day as your request. We will decide whether to fund your case after receiving a complete application and all required information and documentation. We will make a decision as soon as possible. Rest assured that we understand your situation and will do everything we can to help immediately.
6What happens after I submit my litigation funding application?
We will work to get all necessary information to make a legal funding decision. We will contact you when we decide whether to fund your case, by telephone if possible, so make sure we have a good contact phone number. We will also contact you if any of the information you provided is incomplete.
7How can I learn the status of my lawsuit funding request?

To learn the status of your pre-settlement funding application at any time, please click on our status application or call our toll-free Status Line at 1-866-977-6506. You can access the status of your legal funding application by following the prompts. Your password is your date of birth, including the year. Please use four digits to indicate the year, e.g. 1971 rather than 71, and please DO NOT add a zero if the month or day is just one digit, e.g. January 1, 1971 = 111971.

8Is there anything I can do to speed up the process?
We will perform all of the work required to process your funding advance. After you submit your legal funding application, please contact your attorney/law firm and let them know you consent to speak with us and allow LawCash to collect any information or documents necessary to make a decision.
9My case settled and we signed a settlement agreement but have not received payment. Can you help?
Yes, absolutely. Our post-settlement funding process is very rapid. This type of legal funding is for cases which have already settled, for both plaintiffs and attorneys. 10How does surgery financing work?
Surgery financing applications follow the same process as regular pre-settlement funding. But upon approval, we forward the funds directly to the doctor.
11How do I repay the pre-settlement funding advance?
If we fund your case, LawCash® will enter into a lawsuit funding agreement with you and your attorney. The agreement will set forth the amount of the lawsuit advance provided and any costs that apply. If you win your lawsuit, the advance's repayment will be due when you receive your settlement or award. If you lose your lawsuit, you owe LawCash® nothing.
12How much money can I get from litigation funding?
We will advance a minimum of $500 in pre-settlement funding and we have no set maximum amount for a funding advance. The amount of pre-settlement funding depends on the facts and type of case.
13Will Law Cash check my credit history??
LawCash® will not review your credit history when determining whether to fund your lawsuit.
14Can I talk to my attorney about your pre-settlement funding services?
Yes, absolutely. We encourage you to talk to your attorney about applying for a pre-settlement funding advance through LawCash®.
15Why would my attorney not recommend using pre-settlement funding services?

Your attorney may not have had experience with LawCash® or the financial difficulties faced by personal injury victims and other plaintiffs.

Your attorney might be concerned about the following:

  1. The cost of pre-settlement funding services and whether the repayment will affect attorney fees;
    Your attorney may not know that LawCash® pre-settlement funding is non-recourse, meaning that we're repaid on a contingency basis. You only repay us if you receive a settlement or award. You owe LawCash® nothing if you lose your case. Attorneys' fees are settled and paid before LawCash® receives any portion of a settlement or award.
  2. Potential influence on the attorney's handling of your case;
    LawCash® will not interfere with your case. We gather information about your case during the funding application phase. We have no other involvement in your case. We will not attempt to influence or involve ourselves in the attorney's handling of your lawsuit in any manner.
  3. The administrative work involved;
    At LawCash®, we do not require the completion of an attorney questionnaire before determining whether to fund a lawsuit. LawCash® handles the majority of the clerical work involved in the legal funding process. The application process is fast and easy for plaintiffs and attorneys.
16How do I apply?

17What if the amount funded is not enough? Will you provide additional funding?
You are always welcome to come back and ask for another legal funding advance. Fill out our Request for Additional Funding Application. Please note that this application is only for clients who have already received litigation funding from LawCash® and would like to receive additional lawsuit funding.
18What are rolling contracts in lawsuit funding and how can they help?
LawCash® can structure your funding advance as a rolling contract, which provides you with more flexibility and lower rates than traditional lump-sum payments. For example, with a litigation funding rolling contract, we can approve an advance of $24,000 and give you $2,000 a month for up to twelve months, rather than in a lump sum of $24,000. Rolling contracts enforce financial discipline and cost you less.
19Does Law Cash have any special way of delivering my lawsuit funding advance?

Yes. There are many ways for you to receive your LawCash® lawsuit funding advance, including coming to our office in New York and picking it up.
